1. ACCOMMODATIONS
Individually and privately owned, each rental home and condominium reflects the taste of its owner. Specialty items vary. If a guest is renting more than one home or condo, we ask that you do not move items from one unit to another. Every effort has been made to assure accurate descriptions with no misrepresentations intended. Pajaro Dunes Resort will not be held responsible for errors in printing, changes made by homeowners, or matters beyond our control, e.g. electrical outages, noise, construction, weather, etc.

2. AREA GROWTH
Remodeling and upgrading is occurring constantly at Pajaro Dunes. When we have been notified of upcoming construction, we will make every effort to notify guest of potential noise. If requested, we will try to relocate guest to a comparable unit free of construction. If no such unit is available, guest will have the option to cancel the reservation and receive a full refund of any monies paid. In some instances, we may not be notified of work being performed. If this happens, Pajaro Dunes Resort cannot be responsible for noise and there will not be a reduction of rent or refund.

3. CHECK-IN
Check-in time is 4:00 p.m. Please remember that if you are arriving on the day of another guest's departure, the home or condo must be readied for occupancy within a very short time frame. A guest's arrival at 4:00 pm. allows time to ensure that each home and condo is clean, inspected, and ready for occupancy.

4. CLEANING
To ensure that homes are well maintained, cleaning and inspection will occur after each departure. The departing guest is required to: Empty all trash cans and remove trash from area outside the home, load (but do not start) the dishwasher, return furniture and other contents to its original position, turn off all appliances (including heat), and make sure all doors and windows are securely locked before leaving the unit.

5. FORMS OF PAYMENT
Cash, money order, cashier's check, personal check, MasterCard, and Visa.

6. KEYS
Two keys will be available for each home or condo. Keys are presented upon check-in and must be returned to the Pajaro Dunes Resort office upon departure. Charge for not returning keys will be $25.00 for each key. If you require more than two keys, please inquire at the time of check-in to see if additional keys are available.

7. MAINTENANCE / REFUNDS
All equipment in each home or condo should be in working order. Please report any inoperative equipment to the Reception Center promptly! We will make every reasonable effort to have the problem corrected or relocate you to a comparable rental unit if the problem cannot be corrected expeditiously. If no such unit is available, guest will have the option to cancel the reservation and receive a full refund of monies paid for any unused rental nights. Unless agreed to by the homeowner, there will be no reduction of rent or refund for any mechanical failure of heating unit, dishwasher, washer, dryer, TV, VCR, blender, toaster, or other appliances. While rare, all pools/hot tubs are subject to temporary closing due to extenuating circumstances. No refund or rent reduction will be given if this occurs. While we understand that maintenance issues can arise at any time, we ask that any after hour's maintenance request be of an emergency nature only. If an after hours maintenance request is deemed to be a non-emergency, we will make every effort to correct the problem as soon as the office re-opens the following day.

8. MESSAGES / MAIL
Messages and mail may be received through and picked up at the Pajaro Dunes Resort office. We do not deliver messages except in cases of extreme emergency. After hours emergency messages should be directed to (800) 564-1771. Your unit's telephone number is listed on the rental confirmation. The Reception Center will not divulge any unit's telephone number to persons not listed as "renter" on the confirmation.

9. OCCUPANCY
The number of guests occupying a property is limited to the number stated on the rental confirmation with the exception of an infant requiring a crib. These limits are strictly enforced. Exceeding the specified occupancy constitutes a breach in the rental agreement and may lead to termination without refund of rent.

10. OFFICE HOURS
8:00 AM - 5:30 PM, seven days a week except on most Fridays we are open until 7:00 PM. The office will close early Thanksgiving Day and will be closed entirely on Christmas Day. After hours maintenance/emergency phone number: (831) 728-7400. If you arrive to check in after our office closes, your check-in packet will be at the Gatehouse. This gatehouse is open 24 hours a day - 7 days a week and will be able to give directions to your unit and provide extra car passes should you require them.

11. PERSONAL PROPERTY
Pajaro Dunes Resort will not be responsible for personal items or money left in any rental unit.

12. PETS
Absolutely no pets are permitted in or on Pajaro Dunes properties. No exceptions will be made! Violation of this policy will result in fines being levied by the Pajaro Dunes Homeowner Association and may result in immediate eviction with no rental refunds.

14. RESERVATIONS / PAYMENTS / CANCELLATIONS
20% of a reservation's base rent is due within 14 days of the booking date. An additional 30% of the base rent is due 90 prior to occupancy. The remaining balance is due 30 days prior to occupancy. If a reservation is canceled more than 30 days prior to occupancy, any deposit monies, less a $65.00 booking fee, will be refunded in the same manner the deposit was paid. If a reservation is canceled less than 30 days prior to occupancy and we are unable to re-rent the unit for the same dates, any deposit monies, less a 50% forfeiture fee, will be refunded in the same manner the deposit was paid. Reservations made less than 30 days prior to occupancy will require the full amount paid by credit card. Guests making a reservation in which the arrival date is less than 30 days in advance may overnight a money order or cashiers check, however, we cannot confirm the reservation until full payment is received.

15. DAMAGES
In lieu of a cash deposit, Pajaro Dunes Resort has established a Damage Deposit Waiver. The charge for this waiver is $37.00 and up, depending on the size of the rental unit. This waiver covers up to $2000.00 in damages to the unit as a result of your inadvertent acts or omissions. The Damage Deposit Waiver does not cover negligent or willful and wanton misconduct. For a full description of the waiver, refer to the enclosed Damage Deposit Waiver form. If a form is not enclosed, please contact our Reception Center for a copy. You must notify our office of any damage to the unit or its furnishings during your occupancy or this waiver is void. Our inspectors walk through each unit after check-out to ensure the property is left in good order. Guest's credit card may be used as additional damage payment. Charges to guest's card may include, but are not limited to: damages over normal wear and tear that are not reported before check-out, theft, excessive cleanup, unauthorized late check-outs, evidence of a pet in the unit, and fines levied by the Pajaro Dunes Homeowner Association.

16. SUBSTITUTION / NON-AVAILABILITY
Should the home or condo confirmed by the guest become unavailable for any reason whatsoever, Pajaro Dunes Resort will inform guest when non-availability is absolutely certain, and prior to check-in whenever possible. Every attempt to relocate guest to a comparable rental unit will be made Guest may be responsible to pay any rental amount on a substitute home or condo that exceeds the original rental amount. If no such unit is available, guest will have the option to cancel the reservation and receive a full refund of any monies paid.

17. TELEPHONES
All short term rental units are equipped with telephones that allow free local and long distance calling. For dial-up modems, however, a local access number is still required.

18. FURNISHINGS
The owner has furnished the unit with basic needs for housekeeping, cooking, etc. Linens, pillows, blankets, paper products, etc have been provided. Condiments, spices, and cleaning supplies may not be provided. Pools, hot tubs, whirlpools, elevators, and other special amenities will be maintained as well as possible, but no refunds will be given with regards to the condition of these special amenities.

19. BEACH RULES / REGULATIONS
Beach is closed from 10 pm - 6 am. No alcoholic beverages or glass containers are allowed on the beach. Bonfires are only allowed in designated fire rings. There are fire rings directly in front of the State Park area and Shorebirds Condos. Bar-B-Ques and their drip pans are NEVER to be taken to the beach. The BBQ and drip pan must stay on the deck at all times. Removing the drip pan is a very dangerous fire hazard and may result in fines. 20. CAMPERS
No campers, tents, motorcycles, or motorhomes are allowed on the premises. Please inquire about special parking off premises.

21. MAINTENANCE BY TENANT
Tenant shall comply with all laws and keep the premises clean and safe as possible. Dispose of all garbage and properly use the trash cans as provided and required. Keep the plumbing free of toys and other foreign items.

22. LATE CHECK-OUT
An approved late check-out may be available. Unauthorized late check-out may cause the tenant to be charged an additional night's rent.

23. RENTAL RATES and FEES

24. RIGHT OF ENTRY
Pajaro Dunes Resort, owner, or their representatives have the right to enter premises during tenancy to inspect or make necessary repairs.
